Terms of service
1. Introduction
Welcome to the Definitely Humanz project (the “Project”). These terms of service (the “Terms”) govern your use of the Project and any NFTs (non-fungible tokens) purchased through the Project. By using the Project or purchasing an NFT, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Project or purchase any NFTs.
2. Eligibility
You represent and warrant that you are at least 18 years of age or the legal age of majority in your jurisdiction, whichever is greater. By using the Project or purchasing an NFT, you represent and warrant that you have the right, authority, and capacity to enter into and be bound by these Terms.
3. Ownership of NFTs
3.1. When you purchase an NFT through the Project, you are purchasing ownership of the ERC721A token.
3.2. As the owner of an NFT, you may view, display, and transfer the NFT as you see fit, subject to any applicable laws or third-party platform rules.
4. Risks
4.1. You understand that there are risks associated with purchasing and owning NFTs, including but not limited to the following:
4.1.1. The market for NFTs is highly speculative and volatile, and the value of an NFT may decrease or become worthless.
4.1.2. The technology used to issue and transfer NFTs is still in its early stages and may contain flaws or vulnerabilities that could lead to the loss of your NFTs.
4.1.3. The use of NFTs and related technologies may be illegal or restricted in some jurisdictions, and you are responsible for ensuring compliance with all applicable laws.
5. Disclaimer
5.1. The Project is intended solely as a collectible Non-Fungible Token. It is not intended to be an investment vehicle.
5.2. We make absolutely no promise or guarantee that these NFTs will be worth anything more than what you and the market deem them to be worth. You understand that they have no inherent monetary value, and they should be treated as nothing more than a collectible with potential future value or lack thereof.
6. Limitation of Liability
6.1. To the maximum extent permitted by law, we shall not be liable for any damages of any kind arising from the use of the Project or the purchase of NFTs, including but not limited to direct, indirect, incidental, punitive, and consequential damages.
7. Governing Law and Jurisdiction
7.1. These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Project is based, without giving effect to any principles of conflicts of law.
7.2. Any dispute arising out of or in connection with these Terms shall be resolved by the courts of the jurisdiction in which the Project is based.
8. Changes to These Terms
8.1. We reserve the right to make changes to these Terms at any time and without prior notice. Your continued use of the Project or purchase of NFTs after any changes to these Terms shall constitute your acceptance of such changes.
